1. Introduction
Welcome to Tails Up ("Platform", "Service", "we", "us", "our"), a pet care management platform operated by SmashTech Ltd, a company registered in Athens, Greece ("Company").
These Terms and Conditions ("Terms") govern your access to and use of the Tails Up website at https://tailsup.gr, the Tails Up mobile application (available on iOS and Android), and all related services, features, and content (collectively, the "Service").
By creating an account, accessing, or using the Service, you ("User", "you", "your") acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Cookies Policy. If you do not agree to these Terms, you must not use the Service.
2. Eligibility
2.1. You must be at least 18 years of age to create an account and use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
2.2. If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2.3. The Service is primarily intended for users located in the European Union. If you access the Service from outside the EU, you are responsible for compliance with your local laws.
3. Account Registration and Security
3.1. Account Creation
To use the Service, you must create an account by providing accurate and complete information, including a valid email address and a secure password. You may also register using third-party authentication providers (Google, Apple).
3.2. Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Notifying us immediately at support@tailsup.gr of any unauthorised access or use of your account.
We are not liable for any loss or damage arising from your failure to maintain the security of your account.
3.3. Guest Accounts
The Service may offer guest accounts with limited functionality and a trial period. Guest accounts are subject to automatic deletion after the trial period expires. Data associated with expired guest accounts may be permanently deleted.
3.4. Biometric Authentication
The mobile application may offer biometric authentication (Face ID, Touch ID, fingerprint) for convenience. Biometric data is processed entirely by your device's operating system and is never collected, transmitted to, or stored by us.
3.5. Account Accuracy
You agree to keep your account information accurate and up to date. We reserve the right to suspend or terminate accounts that contain materially inaccurate information.
4. Description of the Service
4.1. Platform Overview
Tails Up is a pet care management platform that provides the following features:
- Pet Profiles: Create and manage profiles for your pets, including species, breed, medical information, photos, and documents.
- Pet Events and Calendar: Schedule and track pet care events such as veterinary appointments, vaccinations, medications, grooming, and more.
- Pet Sharing: Share pet profiles with family members, pet sitters, veterinarians, and other trusted individuals with role-based permissions.
- Business Directory: Discover and review local pet care businesses including veterinarians, groomers, trainers, pet sitters, and more.
- Training Programs: Access pet training programs and track progress.
- Feeding and Health Tracking: Manage feeding schedules and monitor pet health data.
- Content and Articles: Access pet care articles and educational content.
4.2. Platform Role
Tails Up is a technology platform that connects pet owners with information, tools, and pet service business listings. We do not provide veterinary advice, pet care services, or any professional pet-related services directly. Any business listings, reviews, or content on the Platform are provided for informational purposes only.
We are not a party to any agreement or transaction between users and third-party businesses listed on the Platform. We do not endorse, guarantee, or assume responsibility for any products, services, or advice offered by third-party businesses.
4.3. No Veterinary or Medical Advice
The Service does not provide veterinary, medical, or professional pet care advice. Information available through the Service, including content generated by artificial intelligence, is for general informational purposes only and should not be used as a substitute for professional veterinary advice, diagnosis, or treatment. Always consult a qualified veterinarian for your pet's health concerns.
5. Subscription Plans and Fees
5.1. Subscription Tiers
The Service offers the following subscription tiers:
- Free: Basic functionality with limited features.
- Silver: Enhanced features with expanded usage limits.
- Gold: Premium features with higher usage limits.
- Platinum: Full access to all features with the highest usage limits.
Current pricing, features, and limits for each tier are displayed on the Platform and may be updated from time to time. Prices are in Euros (EUR) and include applicable taxes (VAT).
5.2. Billing and Payment
5.2.1. Subscriptions are billed on a monthly or yearly recurring basis, depending on your selection.
5.2.2. Payments on the website are processed by Stripe, a third-party payment processor. Payments on the mobile application are processed through Apple App Store (iOS) or Google Play Store (Android) via their respective in-app purchase mechanisms. Your use of these payment services is subject to their respective terms and privacy policies.
5.2.3. We do not store your full payment card details. Payment information is handled directly by our payment processors in compliance with applicable security standards (PCI-DSS).
5.3. Auto-Renewal
5.3.1. Your subscription will automatically renew at the end of each billing period (monthly or yearly) unless you cancel before the renewal date.
5.3.2. You will be charged the then-current subscription fee for the renewal period. We will notify you of any price changes before they take effect.
5.3.3. By subscribing, you expressly consent to automatic recurring charges.
5.4. Cancellation
5.4.1. You may cancel your subscription at any time through:

Apple App Store subscription management (for iOS subscriptions).

Google Play Store subscription management (for Android subscriptions).
5.4.2. Cancellation takes effect at the end of the current billing period. You will retain access to your subscription features until the end of the period for which you have already paid.
5.4.3. No refunds will be issued for partial billing periods, except as required by applicable law.
5.5. Refunds
5.5.1. For subscriptions purchased through the website (Stripe), refund requests may be submitted to support@tailsup.gr within 14 days of purchase, in accordance with the EU Consumer Rights Directive, provided you have not substantially used the Service during that period.
5.5.2. For subscriptions purchased through Apple App Store or Google Play Store, refunds are handled by the respective platform in accordance with their refund policies.
5.6. Promotional Slots (Business Owners)
Business owners may purchase promotional slots to increase visibility on the Platform. Promotional slot terms, pricing, and cancellation policies are displayed at the time of purchase. Refunds for promotional slots are subject to the cancellation cutoff policy disclosed at the time of booking.
5.7. Free Trials
If we offer a free trial, you may be required to provide payment information. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate.
6. User Content
6.1. Your Content
You retain ownership of all content you submit, upload, or make available through the Service ("User Content"), including pet photos, documents, reviews, and profile information.
6.2. Licence Grant
By submitting User Content, you grant SmashTech Ltd a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to use, reproduce, modify, adapt, publish, display, and distribute your User Content solely for the purposes of operating, improving, and promoting the Service. This licence terminates when you delete your User Content or your account, except where your content has been shared with other users or where retention is necessary for legal compliance.
6.3. Content Responsibilities
You represent and warrant that:
- You own or have the necessary rights to submit your User Content.
- Your User Content does not infringe the intellectual property, privacy, or other rights of any third party.
- Your User Content is accurate and not misleading.
- Your User Content complies with these Terms and applicable law.
6.4. Content Moderation
We reserve the right to review, remove, or disable access to any User Content that, in our sole discretion, violates these Terms, is harmful, offensive, or otherwise objectionable, or may expose us or our users to liability.
7. Pet Data and Sharing
7.1. Pet Information
You are solely responsible for the accuracy and completeness of all pet information you provide, including health records, medical history, microchip numbers, and veterinary documents.
7.2. Pet Sharing
7.2.1. The Service allows you to share pet profiles with other users under specified roles (Family Member, Sitter, Veterinarian, etc.) with configurable permissions.
7.2.2. When you share a pet profile, the recipient will have access to the pet information based on the permissions you grant. You are responsible for managing who has access to your pet's data.
7.2.3. You may revoke shared access at any time.
7.3. Pet Ownership Transfers
The Service may facilitate ownership transfers of pet profiles. Ownership transfers are permanent once completed. You are responsible for ensuring that transfers are intentional and authorised.
7.4. Pet Liability
You are solely responsible for your pets and their behaviour. SmashTech Ltd is not liable for any injuries, damages, or losses caused by your pets or arising from any pet care decisions you make based on information available through the Service.
8. Business Listings
8.1. Business Owner Responsibilities
If you register as a business owner on the Platform, you represent and warrant that:
- You are legally authorised to operate the business.
- All business information (name, address, contact details, hours, services) is accurate and up to date.
- Your business holds all required licences, permits, and insurance.
- You comply with all applicable laws and regulations.
8.2. Reviews
Users may submit reviews and ratings for businesses listed on the Platform. Reviews must be honest, based on genuine experiences, and not defamatory, abusive, or misleading. We reserve the right to remove reviews that violate these Terms.
8.3. No Endorsement
Listing a business on the Platform does not constitute an endorsement, recommendation, or guarantee by SmashTech Ltd. We do not verify the qualifications, licences, or quality of listed businesses unless explicitly stated as "Verified."
9. Prohibited Activities
You agree not to:
9.1. Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
9.2. Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
9.3. Submit false, misleading, or fraudulent information.
9.4. Interfere with or disrupt the Service, servers, or networks connected to the Service.
9.5. Attempt to gain unauthorised access to any part of the Service, other users' accounts, or any systems or networks connected to the Service.
9.6. Use automated means (bots, scrapers, crawlers) to access, collect data from, or interact with the Service without our prior written consent.
9.7. Upload or transmit viruses, malware, or any other malicious code.
9.8. Harass, abuse, threaten, or intimidate other users.
9.9. Use the Service to send unsolicited commercial messages (spam).
9.10. Reverse engineer, decompile, or disassemble any part of the Service.
9.11. Circumvent any access restrictions, rate limits, or security measures of the Service.
9.12. Use the Service in any manner that could damage, disable, overburden, or impair the Service.
10. Intellectual Property
10.1. Our Property
The Service, including its design, text, graphics, logos, icons, images, software, source code, and all related intellectual property, is owned by or licensed to SmashTech Ltd and is protected by copyright, trademark, and other intellectual property laws. The "Tails Up" name, logo, and branding are trademarks of SmashTech Ltd.
10.2. Limited Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes in accordance with these Terms.
10.3. Restrictions
You may not copy, modify, distribute, sell, lease, sublicence, or create derivative works from any part of the Service without our prior written consent.
11. Third-Party Services
11.1. Integration with Third Parties
The Service integrates with third-party services including, but not limited to:
- Firebase (authentication, push notifications)
- Stripe (payment processing)
- Apple App Store and Google Play Store (in-app purchases and subscriptions)
- RevenueCat (subscription management on mobile)
- Google Maps (map display and business location)
- PostHog (analytics)
- Sentry (error tracking)
- Cloudflare (content delivery and file storage)
11.2. Third-Party Terms
Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.
11.3. External Links
The Service may contain links to third-party websites or services. We do not endorse and are not responsible for the content, accuracy, or practices of third-party websites.
12. Disclaimer of Warranties
12.1. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
12.2. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SMASHTECH LTD DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
12.3. We do not warrant that:

The Service will be uninterrupted, timely, secure, or error-free.

The results obtained from the Service will be accurate or reliable.

Any defects in the Service will be corrected.
12.4. Any content generated by artificial intelligence features is provided for informational purposes only and may contain inaccuracies.
12.5. Nothing in these Terms excludes or limits warranties that cannot be excluded or limited under applicable EU or Greek law, including consumer protection rights under Directive 2011/83/EU.
13. Limitation of Liability
13.1. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SMASHTECH LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, revenue, data, or business opportunities.

Loss of or damage to pet health, wellbeing, or property.

Personal injury or property damage arising from your use of the Service or reliance on information obtained through the Service.

Any conduct or content of any third party on the Service.

Unauthorised access to or alteration of your data.
13.2. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED EUROS (€100).
13.3. THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE).
13.4. Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under applicable EU or Greek law.
14. Indemnification
You agree to indemnify, defend, and hold harmless SmashTech Ltd, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:
14.1. Your use of the Service.
14.2. Your violation of these Terms.
14.3. Your violation of any applicable law or regulation.
14.4. Your User Content.
14.5. Your pets' actions or behaviour.
14.6. Any dispute between you and a third-party business listed on the Platform.
15. Termination
15.1. Termination by You
You may terminate your account at any time by:
- Using the account deletion feature in the Service.
- Contacting us at support@tailsup.gr.
Termination does not entitle you to a refund of any prepaid subscription fees, except as required by applicable law.
15.2. Termination by Us
We may suspend or terminate your account, at our sole discretion, with or without notice, if:
- You violate these Terms.
- We are required to do so by law.
- We discontinue the Service or any part thereof.
- Your account has been inactive for an extended period.
15.3. Effect of Termination
Upon termination:
- Your right to access and use the Service immediately ceases.
- We may delete your account data in accordance with our Privacy Policy.
- Sections of these Terms that by their nature should survive termination will remain in effect, including but not limited to: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Greece, without regard to its conflict of law provisions. Where applicable, the mandatory consumer protection provisions of EU law, including Regulation (EU) 2019/1150 (Platform-to-Business Regulation) and Directive 2011/83/EU (Consumer Rights Directive), shall apply.
17. Dispute Resolution
17.1. Amicable Resolution
In the event of any dispute arising from or relating to these Terms or the Service, the parties shall first attempt to resolve the dispute amicably by contacting support@tailsup.gr. We will endeavour to respond to and resolve complaints within 30 days.
17.2. Online Dispute Resolution
In accordance with Regulation (EU) No 524/2013, EU consumers may submit complaints through the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
17.3. Jurisdiction
If a dispute cannot be resolved amicably, the courts of Athens, Greece shall have exclusive jurisdiction, except where mandatory consumer protection laws of your country of residence grant you the right to bring proceedings in your local courts.
18. Changes to These Terms
18.1. We reserve the right to modify these Terms at any time. We will notify you of material changes by:

Posting the updated Terms on the Platform with a new "Last Updated" date.

Sending a notification through the Service or to your registered email address.
18.2. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and terminate your account.
18.3. For material changes that adversely affect your rights, we will provide at least 30 days' notice before the changes take effect.
19. General Provisions
19.1. Entire Agreement
These Terms, together with the Privacy Policy and Cookies Policy, constitute the entire agreement between you and SmashTech Ltd regarding the Service.
19.2. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
19.3. Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
19.4. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
19.5. Force Majeure
SmashTech Ltd shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power failures, internet outages, or third-party service failures.
19.6. Language
These Terms may be provided in multiple languages. In the event of any conflict between language versions, the English version shall prevail.
19.7. Notices
All notices to SmashTech Ltd should be sent to support@tailsup.gr. Notices to you will be sent to the email address associated with your account.
